Misdiagnosis / Failure to Diagnose
A common area of malpractice is the misdiagnosis of cancer. Often patients are not informed of cancerous cells until it is too late, or a doctor has failed to identify cancer in the victim. We will review medical records and consult with expert witnesses. In the event that your misdiagnosis was due to doctor negligence, we will aggressively pursue the maximum compensation for your case. Differential diagnosis refers to the process by which a doctor identifies symptoms and possible causes. If a doctor fails to identify multiple causes of your symptoms, they may have failed in the necessary process of differential diagnosis, or reassessment.
It is a devastating realization to any victim and family that the progression of cancer could have been prevented. Our attorney is experienced in investigating possible failures to diagnose or misdiagnosis and recovering rightful compensation to victims and their families.
Surgical errors
Surgical errors include improper placement of medical devices, failure to remove instrumentation, nerve damage as a result of improper use, or erroneous use of surgical clamps. Our attorney has taken cases involving nerve damage, mistakes in anatomy, loss of limb resulting in irreparable tissue damage; and cutting or removing the wrong organ, artery, vessel, or duct.
Emergency room errors
In addition to misdiagnosis and surgical error, we routinely handle cases involving emergency room errors. Emergency errors often result from understaffed emergency rooms and failing to diagnose certain life-threatening conditions properly. Many emergency room patients are misdiagnosed only to later suffer a stroke, heart attack, brain injury, or other serious injury after being prematurely discharged. These cases can be critical where, for example, a fatal heart condition may be identifiable, but go untreated, an emergency room physician fails to diagnose appendicitis, signs of stroke, or some other serious condition is not recognized.
